These Terms of Use ("Terms") govern your use of the BreakMoves mobile application (the "App") provided by BreakMoves ("BreakMoves," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Health notice: BreakMoves provides general movement and exercise content. It is not medical advice. Always consult your doctor before starting a new exercise routine, move at your own pace, and stop if anything hurts. You use the movement content at your own risk.

1. Who can use the App

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. By using the App you confirm that you meet this requirement.

2. What BreakMoves does

The App helps you fit short movement breaks into your day — for example, during TV commercial breaks (TV mode), on a timer (Nudge mode), or whenever you choose to start one. TV mode uses your device's microphone on-device to recognize commercial breaks; detection is not perfect and results vary by show and environment. The App is designed so you can always start a break yourself.

3. Health and safety disclaimer

The App is for general wellness and movement and is not a medical device and does not provide medical advice. The content is not a substitute for professional medical guidance, diagnosis, or treatment. Consult a qualified healthcare provider before beginning any exercise program, especially if you have a health condition, injury, are pregnant, or have any concerns about your ability to exercise. Do not disregard professional medical advice because of anything in the App. By using the movement content, you accept full responsibility for exercising safely and within your own limits.

4. Your responsibilities

Use the App only for lawful, personal, non-commercial purposes.
Do not copy, modify, reverse-engineer, or attempt to extract the App's source code or content, except as allowed by law.
Do not use the App in a way that could harm, disable, or interfere with it or others' use of it.
Keep your device and any account credentials secure.

5. Microphone permission

TV mode requires microphone access to work, and all audio is processed on your device as described in our Privacy Policy. You may decline or revoke microphone access at any time in your device settings; the App remains usable without it through Nudge mode and manually started breaks.

6. Subscriptions and payments

The App may offer free features as well as paid subscription features ("Premium"). If you purchase a subscription, payment is charged to your Apple ID account through the App Store. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings. Prices and features may change; we will provide notice where required. Except where required by law, payments are non-refundable, and refunds are handled by Apple under its policies.

7. Beta testing

If you access the App as part of a beta or early-access program, you understand the App is a work in progress, may contain bugs or incomplete features, and may change or stop working. Beta features are provided "as is," and we welcome your feedback, which we may use to improve the App without obligation to you.

8. Intellectual property

The App, including its content, design, graphics, characters (including "Spud"), and the BreakMoves name and branding, is owned by BreakMoves and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use. These Terms do not transfer any ownership rights to you.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation. We do not warrant that commercial-break detection will be accurate or that the App will meet your expectations.

10. Limitation of liability

To the fullest extent permitted by law, BreakMoves and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or injury arising from your use of the App or the movement content, including any physical injury resulting from exercise. Your use of the App and its movement content is at your own risk. Where liability cannot be excluded, it is limited to the amount you paid us, if any, in the twelve months before the claim.

11. Changes to the App and these Terms

We may modify, suspend, or discontinue the App or any feature at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above. Continued use of the App after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws rules, except where your local consumer-protection laws require otherwise.
